Kevin Abbott manages all litigation at Lobb & Plewe LLP. His litigation experience spans his entire legal career, and covers all areas that matter to business owners and entrepreneurs.
Mr. Abbott focuses on providing efficient, creative, and realistic litigation strategies to his clients, whether those clients are individuals, small local businesses, or large corporations. Mr. Abbott recognizes that there is no "one size fits all" strategy, and that litigation success must always be measured against its costs. Often, this means an aggressive, no-nonsense approach; at other times, this means working towards a productive settlement. Each case requires individual consideration, both at the outset and as the matter evolves.
Mr. Abbott has achieved litigation success in all settings, including trials (both jury and court trials), arbitration, motions for summary judgment, motions to dismiss, mediation, and countless efficient resolutions via settlement. One notable recent outcome was a complete defense verdict for his clients in a multi-million dollar federal jury trial. He is skilled at all facets of litigation, including arguing motions with forceful reason, crafting pinpoint discovery, defending and taking depositions, and preparing for trial. Mr. Abbott has extensive experience with federal and state judges, as well as private arbitration and mediation. In addition to trial matters, Mr. Abbott is a skilled appellate advocate, and his arguments are found in published Court of Appeal precedent.
Mr. Abbott's litigation practice includes employment law, class actions, trade secrets, copyright, construction disputes, collection matters, contract disputes, real estate litigation, and partnership disputes. By way of example, he has recently defended businesses from employee lawsuits under California's onerous Private Attorney General Act ("PAGA"). This law in particular requires careful and aggressive strategy to overcome the hurdles placed in employers' paths.
Mr. Abbott also advises his clients outside of litigation. This includes advising clients in a variety of business disputes with customers, vendors, and competitors. Mr. Abbott also regularly advises clients who are dealing with public agencies, including eminent domain, regulatory, and code enforcement matters.
Mr. Abbott graduated magna cum laude from the J. Reuben Clark School of Law at Brigham Young University. While a law student, he was a semifinalist in the Rex E. Lee Moot Court Competition, and also joined the school’s extramural moot court competition team. Prior to law school, Mr. Abbott graduated magna cum laude from Brigham Young University with a degree in economics.
Mr. Abbott is a member of the State Bar of California and the Riverside County Bar Association. A native of Yorba Linda, California, he now lives in Riverside with his wife and four children.
